1. About GrowMyPod

GrowMyPod is a software-as-a-service (SaaS) platform designed to assist podcast creators by providing podcast analytics, growth recommendations, SEO insights, content opportunities, competitive intelligence, and related podcast optimisation tools.

GrowMyPod provides information, recommendations, and analytical insights only. We do not guarantee podcast growth, rankings, downloads, audience increases, revenue outcomes, or any other specific result.

2. Eligibility

You must be at least 18 years of age to use GrowMyPod.

By creating an account, you represent and warrant that:

• You are legally capable of entering into a binding agreement.
• All information you provide is accurate and current.
• You have authority to connect and analyse any podcast RSS feed submitted through the platform.

3. Account Registration

To access the Service, you must create an account.

You agree to:

• Maintain the confidentiality of your login credentials.
• Be responsible for all activities conducted under your account.
• Notify us immediately of any unauthorised access or security breach.

We reserve the right to suspend or terminate accounts that contain false, misleading, or fraudulent information.

4. Subscription Plans and Free Trials

GrowMyPod may offer free trials, promotional offers, and paid subscription plans.

Free trials are offered at our sole discretion and may be modified or withdrawn at any time.

At the conclusion of a free trial, your access is suspended and a paid plan is required to continue access. Subscription pricing is displayed on the GrowMyPod website and may be updated from time to time.

All prices are stated in Australian Dollars (AUD) unless otherwise specified.

GST may apply where required by law.

5. Payments

You authorise GrowMyPod and its payment providers to charge applicable subscription fees using your nominated payment method.

You are responsible for ensuring your payment details remain current and valid.

Failure to successfully process subscription payments may result in suspension or termination of access to the Service.

6. Cancellation

You may cancel your subscription at any time through your account settings.

Cancellation will prevent future subscription charges.

Unless otherwise required by Australian Consumer Law, subscription fees already paid are non-refundable.

Cancellation does not automatically entitle you to a refund for any unused portion of your subscription period.

7. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth) or any other applicable law.

Where our services are supplied to consumers, they come with guarantees that cannot be excluded under Australian Consumer Law.

To the extent permitted by law, our liability for any breach of a consumer guarantee is limited to:

• Re-supplying the services; or
• Paying the cost of having the services supplied again.

8. Acceptable Use

You must not:

• Use the Service for unlawful purposes.
• Attempt to reverse engineer, decompile, or copy the platform.
• Interfere with the operation or security of the Service.
• Upload malicious code or harmful software.
• Use automated methods to scrape, harvest, or extract data from the platform.
• Use the Service to infringe intellectual property rights.

We may suspend or terminate accounts that breach these Terms.

9. Podcast Data and RSS Feeds

By connecting a podcast RSS feed, you grant GrowMyPod permission to access, process, analyse, and display podcast-related information for the purpose of providing the Service.

You represent that:

• You own or control the podcast content; or
• You have lawful authority to connect and analyse the podcast.

You remain responsible for all content associated with your podcast.

10. Intellectual Property

All intellectual property rights in the GrowMyPod platform, software, branding, content, reports, algorithms, designs, and underlying technology remain the property of GrowMyPod or its licensors.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

You may not reproduce, distribute, modify, sell, license, or commercially exploit any part of the Service without our prior written consent.

11. Reports, Recommendations and AI Content

GrowMyPod may generate reports, recommendations, content suggestions, growth forecasts, SEO guidance, or AI-generated outputs.

These outputs are provided for informational purposes only.

You acknowledge that:

• Recommendations may not always be accurate.
• AI-generated outputs may contain errors or omissions.
• Business, marketing, and growth decisions remain your responsibility.

GrowMyPod does not guarantee any particular outcome resulting from the use of recommendations or insights generated by the platform.

12. Third-Party Services

GrowMyPod may integrate with or rely upon third-party services including podcast hosting platforms, analytics providers, AI services, search engines, payment processors, and other technology providers.

We are not responsible for:

• The availability of third-party services.
• Changes made by third-party providers.
• Data inaccuracies originating from third-party sources.

13. Service Availability

While we aim to provide reliable service, GrowMyPod does not guarantee uninterrupted or error-free operation.

The Service may be temporarily unavailable due to:

• Maintenance
• Upgrades
• Technical failures
• Cybersecurity incidents
• Third-party service disruptions

We reserve the right to modify, suspend, or discontinue any feature at any time.

14. Limitation of Liability

To the maximum extent permitted by law, GrowMyPod excludes all liability for:

• Loss of profits
• Loss of revenue
• Loss of business opportunities
• Loss of goodwill
• Indirect or consequential loss

Our total liability arising out of or in connection with the Service is limited to the total subscription fees paid by you during the twelve (12) months immediately preceding the claim.

Nothing in these Terms limits any rights that cannot be excluded under Australian law.

15. Indemnity

You agree to indemnify and hold harmless GrowMyPod, its directors, employees, contractors, and affiliates against any claims, damages, liabilities, costs, or expenses arising from:

• Your use of the Service;
• Your breach of these Terms;
• Your infringement of any third-party rights.

16. Privacy

Your use of GrowMyPod is also governed by our Privacy Policy.

By using the Service, you consent to the collection, storage, and processing of information as described in our Privacy Policy.

17. Termination

We may suspend or terminate your account immediately if:

• You breach these Terms;
• You engage in unlawful activity;
• Continued access creates legal, operational, or security risks.

Upon termination, your right to access the Service immediately ceases.

18. Changes to These Terms

We may update these Terms from time to time.

Where changes are material, we will provide notice through the platform or by email.

Your continued use of the Service after updated Terms are published constitutes acceptance of those changes.

19. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
